Sadly, not all marriages last, and in some instances, it may be advisable to have in place a Pre or Post Nuptial Agreement in the event that the marriage fails.

Such agreements are not as legally binding in England and Wales as they are in other jurisdictions, but when carried out in an appropriate manner, they will be an important consideration for any Court. The only difference between a Pre-Nuptial (prenup) and a Post-Nuptial (postnup) Agreement is that a prenup occurs before the marriage and a postnup occurs afterwards.

Other than this, a prenup and postnup both offer a certain level of protection by setting out how you would like the assets to be divided in the event of divorce, or dissolution of a civil partnership. This might be especially important where one person is bringing more assets in to the marriage than the other and perhaps wishes to retain them.
