We have considerable experience in all aspects of disputes concerning children. We regularly advise clients and appear in Court on their behalf, in respect of “spending time with” and “living with” disputes.

As members of Resolution, we always try to resolve such issues as amicably as possible with a non-confrontational approach, making use of Mediation and other forms of dispute resolution where possible.

As well as disputes over where a child should live (“Residence”) and spend time with the other parent (“Contact”), we can advise on issues relating to child maintenance, Parental Responsibility, Specific Issue (including relocation within the UK and abroad), Prohibited Steps and Special Guardianship, and we have also acted for many extended family members such as Grandparents in relation to their own rights.

It’s important throughout the process that the welfare of the child remain paramount. Solicitors and, in particular, the courts all have a duty to consider the welfare of the child when determining the child arrangements. This is to make sure that the child’s feelings are heard and considered, taking into account their age and understanding, and to ensure that parents are capable of meeting the needs of the child in question.
